Terms of Service
1. Who we are
These Terms of Service ("Terms") are an agreement between you and TraceTile LLC, a limited liability company organized in Arizona ("TraceTile," "we," "us"). They cover the tracetile.app website, the TraceTile app in any form we offer it (in a browser or as an installed app), the free demo, and any license you buy. Together, these are the "Service."
Our Privacy Policy and Refund Policy are part of these Terms.
2. Accepting these Terms
You accept these Terms when you check the box to agree to them as you create an account, or when you buy a license. If you use the free demo without an account, these Terms apply to that use too. If you don't agree, please don't use the Service.
If you accept these Terms for a business or other organization, you confirm that you're allowed to bind it, and "you" includes it.
3. Who can use TraceTile
You must be at least 13 years old to use the free demo, and at least 18 (or the age of majority where you live) to create an account or buy a license.
You can't use the Service or buy a license if you're in a country under a U.S. embargo, or if you're on a U.S. government list of restricted people or companies.
4. The free demo and free trial
The free demo lets you design, trace and color without an account. It doesn't include exporting files.
The free trial lets you use everything, exporting included, for 7 days from when you start it, on up to 2 devices. You start it by signing in (section 6); no payment details are needed and nothing is charged when it ends. When the trial ends, exporting stops unless you buy a license. Your designs, and the files you exported during the trial, stay yours, and you can keep using the demo. Each person gets one free trial, and we may end trials started to get around that.
The demo and the trial are provided as is, and we may change or end either of them at any time.
5. Your license
When you buy TraceTile, we grant you a personal, non-exclusive, non-transferable license to use it through your account on up to 2 devices at a time, for as long as we offer TraceTile (section 11). You're buying lifetime access to the software as an online service, not the software itself, and we keep all rights we don't expressly grant you.
- It belongs to your account. Your license is held by your TraceTile account, not by a device or a copy of the app. Sign in on any device to use it.
- An internet connection. You need one to open TraceTile, sign in, buy, start the free trial and keep your license active. The app checks your license with our servers every few minutes while it's open, and exporting needs that connection: a device that hasn't reached our servers for 15 minutes stops exporting until it does. Your designs are saved on your device as you work. We can't promise that our servers or your connection will always be available (section 14).
- Updates. Your license includes every update we release to TraceTile. We may also offer optional add-ons, such as template packs, at a separate price. You never need one to keep using what you bought.
- One person. A license is for one person. A business may buy a license for one named person. Licenses for several people, such as a studio or a classroom, are available by written agreement with us.
- Devices. You can sign in on any number of devices, and each license works on 2 of them at a time. Opening TraceTile on another device moves it there: the one used longest ago stops exporting until it's used again. Our servers enforce the limit and keep a record of each device on your account (its label, when it was added, when it last checked in and when another device took its place), and our providers log each sign-in (its time, IP address and browser). If those records show your account in use on more than 2 devices at a time, used by more than one person, or an attempt to get around the limit, that's a breach of these Terms. We may then revoke access (section 12) and use those records as evidence in any dispute about it.
6. Your account
You sign in with your email and a password. Your TraceTile account holds your license or free trial and the list of devices you've signed in on. It doesn't hold your designs.
Keep your sign-in secure, and don't share your account. Give us your real name and an email address you use, and keep one account per person. If we see signs that an account is being shared, we may sign out its devices or limit it while we look into it. You can delete your account at any time (section 12).
7. Buying a license
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment, sales tax and VAT, receipts and refunds, and Paddle's Buyer Terms also apply to your purchase.
- Prices are in US dollars. Sales tax or VAT is added at checkout where it applies.
- We may change prices for future purchases. A price change never affects a license you already bought.
- If you buy at a launch or promotional price, your license is the same as one bought at full price.
8. Refunds
The editor is free to use and the 7-day free trial includes every export, so you can try everything before you buy. Purchases are refunded under Paddle's Refund Policy, as our Refund Policy describes; we don't add a separate refund period of our own. When a purchase is refunded or charged back, its license ends.
If you live in the European Union, the United Kingdom, or another place that gives consumers a right to withdraw from a purchase of digital content, you keep that right as Paddle's Buyer Terms and Refund Policy describe it.
9. Your designs
Designs you create and images you add are yours. We claim no ownership of them, and we don't receive them: TraceTile saves your work on your device.
- Backups are up to you. Clearing your browser's storage, uninstalling the app or losing your device can delete your designs. Use Save a copy to keep files of the ones you care about.
- Images. Only add images you have the right to use.
- Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
10. Acceptable use
Please don't:
- share, resell, rent or sublicense your license or your account;
- create accounts with false details, more than one account for yourself, or a new account to get around a suspension, an ended license or the one-trial limit;
- use someone else's account or payment method, or buy a license meaning to charge it back;
- get around, disable or tamper with the license check, the device limit, the demo's export limit or the end of a free trial, or help anyone else do so;
- share, publish or sell a way to unlock exports without a license, such as a key, a modified copy of the app or instructions;
- copy, decompile or reverse-engineer TraceTile, except where the law allows it despite this rule;
- overload our servers, access them by automated means, or probe them for weaknesses (if you find a security problem, please tell us at support@tracetile.app); or
- use the Service to break the law or infringe anyone's rights.
11. What "lifetime" means
A TraceTile license gives your account lifetime access: it lasts for as long as we offer TraceTile, as long as you keep to these Terms. "Lifetime" means the lifetime of TraceTile, not of a person or a device. If we ever decide to stop offering it, we'll tell license holders by email and on this website at least 90 days ahead.
Before the Service ends, we'll email every license holder, at the address on their account, a link to download a final version of TraceTile and instructions for running it on their own device. That version works without an internet connection, signing in or license checks, so you can keep designing and exporting with what you paid for. It includes the features that run on your device. It won't include features that depend on servers or services we run or pay for, such as accounts, share links, cloud storage or AI features (if we ever offer any), because those end with the Service. Keep your account's email address current so the link reaches you.
We may change, add or remove features over time. While we offer TraceTile, we won't take away a paid license's ability to design and export patterns.
12. Ending an account or license
If you end it
You can delete your account at any time by emailing support@tracetile.app. Deleting your account ends your license. It doesn't delete the designs or files on your devices. Deleting your account doesn't come with a refund.
If we end it for cause
We may suspend or end an account or license if you seriously break these Terms (for example by sharing your account, reselling your license or tampering with the license check), or use the Service for fraud or anything illegal. Where it's reasonable, we'll tell you what's wrong first and give you a chance to put it right. We don't need to do that when the breach is deliberate, when it's fraud, or when warning you would let the harm continue. If you dispute a charge with your bank, the license is suspended while the dispute is open, and it ends if the charge is reversed. We don't give refunds when we end a license for cause, and we may refuse you a new account or license afterwards.
To check a suspected breach, we use the account, license and device records described in our Privacy Policy. We never look at your designs, which stay on your device.
Our other rights
Ending an account or license doesn't limit our other rights. If you break section 10 (for example by tampering with the license check, sharing or reselling access, or copying TraceTile), we may also take legal action against you, including claiming the damages the law allows and asking a court to order you to stop. Money alone often can't undo that kind of harm, so you agree we may ask for such an order where the law allows it. We may report fraud and other illegal activity to the authorities. Section 16 covers the costs of claims your breach causes.
If we end it for any other reason
We may also end a license for another reason, but if we do, we'll refund everything you paid for it.
What happens next
When a license ends, you can no longer use the paid features. Your designs and the files you exported stay yours. Sections 9, 10 and 14 to 20 keep applying.
13. Check before you cut
TraceTile helps you plan a piece, but you make the cuts. Before you cut glass or run a machine:
- check that the pattern is the size you expect, for example by printing it and measuring a known line;
- check the fit, the kerf and your machine settings; and
- test on scrap when you can.
Cutting and grinding glass, soldering, working with lead came, and laser or CNC cutting carry real risks, including cuts, burns, fumes and exposure to lead. Follow your tools' instructions and safe workshop practice. The cut check helps you find corners that are hard to cut. It doesn't catch every problem.
We aren't responsible for wasted materials, damaged equipment or injuries that come from cutting or building a design, including a design made with TraceTile's tools or checks.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT PATTERNS, MEASUREMENTS OR CHECKS WILL BE FREE OF ERRORS.
15. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) WE AREN'T LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR WASTED MATERIALS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR YOUR LICENSE, OR US$50 IF YOU HAVEN'T PAID ANYTHING.
Some places don't allow some of these limits, so they may not all apply to you.
16. Responsibility for your content
To the extent the law allows, if someone makes a claim against us because of content you added to TraceTile (such as an image you didn't have the right to use), or because you broke these Terms or the law, you'll cover the reasonable costs of that claim, including reasonable legal fees.
17. Changes to these Terms
We may update these Terms. If a change matters, we'll tell you by email or in the app at least 14 days before it takes effect, and ask you to accept it the next time you sign in. Changes never take away what you already paid for: your license's price, its number of devices and its included updates stay as they were. If you don't accept a change, you can stop using the Service and delete your account.
18. Governing law and disputes
The laws of the State of Arizona govern these Terms, without regard to conflict-of-law rules.
If something goes wrong, please email us first; most problems can be solved quickly. If we can't resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Maricopa County, Arizona, and we both agree to those courts' jurisdiction. Either of us may instead bring an individual claim in small-claims court.
If you're a consumer in the European Union, the United Kingdom or another country whose law lets you bring claims at home or gives you protections that can't be waived, nothing in these Terms takes those rights away.
19. General
- Whole agreement. These Terms, the Privacy Policy, the Refund Policy and, for your purchase, Paddle's Buyer Terms are the whole agreement between us about the Service.
- If part doesn't hold. If a court finds part of these Terms unenforceable, the rest still applies.
- No waiver. If we don't enforce part of these Terms right away, we can still enforce it later.
- Transfers. You can't transfer your license or these Terms. We may transfer them as part of a merger or a sale of our business, and your license stays the same.
- Notices. We'll send notices to the email address on your account. You can reach us at support@tracetile.app.
- Things outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control.
